CYD Endorses SB26-005: Rights Violation in Immigration Enforcement Remedy
Colorado Young Democrats stands firmly with immigrant communities in Colorado and believes all people, regardless of citizenship status, deserve equal rights, treatment, and protection. That starts with ensuring that all Coloradans are protected from and can hold Federal law enforcement accountable for their actions.
This bill strengthens constitutional protections by creating a state law cause for action for violations of the U.S. Constitution that occur in the context of civil immigration enforcement. This bill allows a person whose constitutional rights are being violated during immigration enforcement encounters to bring civil action against the person responsible. Also, a person who violated the U.S. Constitution while participating in civil immigration enforcement is liable to the injured party for appropriate legal or equitable relief.
